In general I'm against the whole "cruel and unusual" nonsense prohibition. Harsh punishment is absolutely necessary to set an example for certain cases. A blanket ban on impalement removes the ability to excise paedophilia rings and foreign infiltration from government effectively, for example.

But javascript? That's cold.
