UPDATE: I spoke with the Asst DA at 4PM yesterday 10/20/05.
Attorney Rex Kindall told me that he is acting upon Abp. Gregory's
initial complaint against me filed with the Chaffee County Sherrifs
Office on September 10 2005.

On 9/12/05 Post #75962 I wrote:

"An ARREST WARRANT by Gregory has been FILED against me. I will be
ARRESTED today 9/12/05. Deptuty Lane of Buena Vista called at 7 AM
to inform me of my imminent ARREST at the hands of Gregory..."

On 9/13/05 Post #76063 I wrote:

"At 7 AM 9/12/05 I received a call from Deputy Lane the Arresting
Officer from Chaffee County Sheriff's Office in Buena Vista CO. He
told me that he had received a call from Abp Gregory on Saturday
9/10/05 accusing me of Theft of 4 Library books, 2 cassocks, 1
belt, and 1 hat."

"...The Police Officer said he went to the Dormition Skete
Monastery, took Gregory's Official Complaint of Theft against me,
and that this accusation was confirmed by other members of the
monastery in addition to bishop Gregory's..."

"...I went back to my apartment and called the Police Officer. He
said, "We have taken a second look at your situation Mr. Kapner and
we decided not to issue an "ARREST WARRANT" against you. Rather, we
are filing a "Case-Report" with the District Attorney for his
review..."

Continuing with regard to my conversation with the DA yesteday
1/20/05, Attrny Kindall said, "If you do not return the alledged
stolen items or if Dr. Andrew Grout does not pay Biship Gregory the
claimed dollar amount of $900 then I will issue the ARREST WARRANT
on Monday. [10/24/05.][Dr. Andrew Grout is Sbn Jerjis'parishioner in
PA. He will be formally leaving Abp Gregory this week.]

I replied to Attorney R Kindall, "I have good reason to do nothing."
I added, "Dr. Grout who called you this morning had no idea that the
dollar amount was set at $900 when he offered in his conversation
with you this morning to pay the equivalent dollar amount of these
alleged stolen items. I inform you now that he will not pay the $900
that Abp Gregory is claiming as equivalent worth."

Asst DA Rex Kindall replied, "If I do not hear from Abp Gregory by
Monday that his claim is satisfied , I will issue the ARREST WARRANT
on Monday." [10/24/05.]

And so dear List Members I am now prepared to bite the bullet and go
back once again to this miserable Jail in Salida CO next week. I can
only wait by the door for the Police to show up.

when on 6/25/05 DS priest-monk Fr Peter Wheeler put me in Jail
for 'stealing the cassock I was wearing.' [See Post #75345

So, to whom to the items really belong? If they belonged to the bishop, you'd give them back, I assume. So they must be yours. Then why do they think their allegation will hold any water? Is it because you received the items when you were a brother at the monastery, and it was never clear whether they gave them to you unconditionally, or whether they are still monastery property?

I'll pray that everything works out, and that you won't go to jail!

[The following is an E-mail I received today 10/21/05 from Dr. Richard Grout, a parishioner of Sbn Jerjis' parish in Du Bois PA. Dr. Grout is still and 'official' member of Abp Gregrory's Jurisdiction. This will not be the case very soon.]

"Dear Brother Nathaniel,

You may post the following anywhere in the world you desire as I testify it is the truth:

Yesterday ( Oct 20, 2005 ) I received an email from the Dormition Skete which said that any allegations of an impending arrest of Milton Kapner were fabrications meant to harm the reputation of the Monastery and Archbishop Gregory.

I decided to verify that by calling the district attorney inSalida, Colorado. I was told by the gentleman that I spoke to in the district attorney's office that even if the assessed value of the objects in question were paid the only way the arrest of Milton Kapner could be prevented on October 24, 2005 was if the Archbishop personally notified the District Attorney's Office that the issure was settled to his satisfaction.

I was told that the matter had to be settled by Friday Oct 21, 2005. I personally have asked the Archbishop to have mercy and drop the charges and seek a less onorous method of settlement.

Dear Vladimir,

I am so distraught. I feel as if my intenstines arewrapped around my brain. What irks me the most is that from the start when DS priest-monk Fr Peter Wheeler put me in Jail on June 25 2005 the Police looked upon my defense with contempt.

On that morning when we all stood outside of Mother Mariam's convent, DS priest monk Wheeler told the Police "Nathaniel Kapner stole that cassock he is wearing."

I replied, "Officers - Fr John Claypool's wife made this cassock for me. I own this cassock ."

The Police, "Mr. Kapner, Fr Peter claims that it is his property. If you do not hand it over we will arrest you."

So you see dear Vladimir the Police couldn't care less what I said in my defense. A few people here in Leadville CO have said to me that I look like I'm "touched by God." This is probably why I do not commandrespect with authority figures.

Now we come to the DA Rex Kindall. He is wholly siding with Abp Gregory and keeps on saying, "Return the items Mr Kapner and I will not issue a WARRANT OF ARREST against you." It does not seem to make a dent dear Vladimir when I respond in my defense. For no sooner do I finish making my defense to this DA that he replys, "I repeat Mr Kapner, if you do not return the items by this Monday October 24 I will issue a WARRANT OF ARREST against you." Ths is what is so mind-confounding about this whole disconcerting affair. I simply can't get any respect.

Right now dear Vladimir I am a nervous wreck. I have the weekend to prepare for the worst. Come Monday I have only to look forward to waiting by the door for the Police to show up. I do not look forward to going back to this Jail in Salida CO. My jailing this past summer at the hands of DS priest-monk Peter Wheeler was nothing short of the most miserable experience I have ever had in my life.

My dear now reposed precious Father, Solomon S Kapner, who raised me on the Ten Commandments I truly feel sorry for. He never envisioned this for his son.

"Mr. Kapner," stated the Police, "this is your last warning. If you do not hand over Fr. Peter's monk's uniform you are wearing, we will arrest you."

"I own this cassock. It was made and given to me by Fr. John Claypool's wife," I replied.

"No officers," answered priest-monk Peter Wheeler "it is owned by Dormition Skete monastery."

"Mr. Kapner,we are not going to ask you again," stated Deputy Vidmar, "turn over Fr. Peter's monk uniform or we will arrest you."

"Then arrest me." I replied.

Deputy Vidmar then ordered me to put my hands behind my back and handcuffed me.He frisked me and then led me into the back of his Chaffee County Sherrif's Police Van.

Deputy Vidmar then had Fr. Peter Wheeler sign his name to "Uniform Summons #30659" which read, "Kapner did unlawfully exercise control of monk-uniform, the property of Fr. Peter Wheeler." Dated 6/25/05

When Deputy Vidmar led me into the Chaffee County Jail in Salida CO the first thing that struck me was the extreme 'sterility.'
The omnipresent fluorescent lights above had made a very strong statement, "Big Brother Is Watching You."

The Warden came up to me and in telegraphic style said, "Mr Kapner. I am not interested in your story. I am here to read to you your rights. I am here to book you into the Chaffee County Prison."

I was then placed into a "Holding Pen." A Prison Officer ordered me to strip and I was thoroughly searched. He then handed to me a "prison uniform." Then after 2 hours I was l led back into the "Inner Prison."

After going through a series of locked doors, I found myself in Prison 'kiosk' ##34. Four young men in their 20's were sitting around a table and with blank faces were staring at a blaring TV on the wall . I knew then that this prison experience was going to be pure torture. They were listening to a rock program that reminded me of my first exposure to 'Heavy Metal.' I learned later that all four of my fellow inmates were in for drug dealing.

I was led to my 'cell' in 'kiosk #34.' The fluorescent lights were even more pronounced. There was a camera fixed on the cell wall to remind me once again, "Big Brother Is Watching You." I sat down on the bunk bed and no sooner did the Prison Officer leave me that I was shocked into attention. A booming voice sounded from a speaker in the cell wall:

"Mr Kapner! Stand up! Lunch is being served!" I said back, "I'm fasting." No reply.I thought to myself,"Big Brother is Ordering."

There were no windows anywhere. No clocks - watches were forbidden. The lights were never turned off. It was continual 'Big Brother.' It was impossible to sleep with the fluorescent lights glaring down at you all night. We were not allowed outside for walks. And -the Television was blasting away.

The next day was Sunday. This was "visiting day." Mother Mariam came to visit me. I was met in my cell by a Prison Officer who put a chain around my ankles. He led me to a window where Mother Mariam was sitting on the other side. After 15 minutes which seemed like 10 seconds the Officer barked at me, "TIME'S UP!" That was it.

I got to know my fellow 'inmates.' I learned that each one of them was "born again." "How did you get born again? I asked them. "We go to a Prison Bible Study led by Pastor Tom. He told us to repeat after him, 'Lord Jesus Christ come into my heart.' He promised to help us when we got out of Jail. So why not say the prayer? We can use the help.." "Do you read the Bible now? Do you pray?" I asked. "NO!" was the resounding answer.

On Monday I had quite enough of the incessant TV blaring 18 hours a day. I simply was frazzled by the constant Noise. I wanted to leave. Iwas hoping for a quiet time of contemplation. But between the TV blasting away,the continual speaker in the cell wall ordering me around, and the harsh omnipresent, omnipotent fluorescent lights, I could not wait to get out of there, go hide in the dark somewhere, and simply listen to silence.

Mother Mariam came with the Buena Vista bail bondsman lady,"Marie." I was free again. "Through the graves the wind is blowing; freedom soon will come; then we'll come from the shadows." (song of the catacomb saints )
