Applying to another jurisdiction does not free one from the jurisdiction of

Indeed the OCA has been prompt enough to defrock its own priests who joined

After Deacon Lev left ROCOR without canonical permission, and resumed serving
while he
was still suspended, he was defrocked....

My goodness, Mr. Puhalo is proving to be more colorful with each one fo your posts. It is indeed amazing to read his speeches, even when he pretends to "care" about his Serbian brethren (whose Holy Patriarchate he of course does not belong...). It is also rumored that he did tried to go with Patriarch Pavle, a Holy Man, and (of course) the Serbian Patriarchate did not even care to reply to his request (for obvious ORTHODOX reasons).

I still can not understand how OCA took him in... this is something of tremendous interest.

Smith has Puhalo as his MENTOR? Now we know the source of all of Smith's conspiratorial garbage.

And hey, I appreciate the support in this forum, but that is OK. Let them take some hits at me, if that makes them feel good for exposing Smith for what he is. I spoke with so many people that knew him over the last 2+ months and that is how I concluded my finds (ALL of which were DOUBLE-verified independently!).

I have seen Mr. Puhalo's name appears (or rather rumored) on several instances throughout the tragedy behind Smith. And I DO MEAN what I said about Smith: He truly IS the biggest victim of them all (other, of course, than his 1,000% innocent family). And I think Puhalo is only ONE of several people who are using Smith. I just have no verification on that, yet... that is, that others are urging him on (and I do not mean Ashley of POEM or the other nutty KVOA interviewees)

Stand by, though, our Good Lord has an interesting way of turning things around -- we all saw what happened with the KVOA manure.

KEEP UP THE GOOD PUHALO RESEARCH COMING. It would also be interesting to pull the thread on his HOCNA associations, especially in his younger days. Some say that HOCNA used him as a mouthpiece, i.e., they SMITHed him (on the issue of Toll Houses)...

STATEMENT OF CLAIM
The Human Rights Institute of Canada is a non-profit corporation under a Grant of Letters Patent dated March 27, 1974 with a registered office at 303-246 Queen Street, Ottawa, Ontario.
His Eminence Lazar Puhalo, Archbishop of the Ukranian Orthodox Archdiocese of Canada, has an address at 37823 Hawkins Road, Dewdney, British Columbia.

Rosemary Larson is an organizer with Citizens Concerned About Free Trade and resides at 1605 Salsbury Drive, Vancouver, British Columbia.

Citizens Concerned About Free Trade ("CCAFT") is an unincorporated association of thousands of Canadians with an office in British Columbia at 210-207 West Hastings Street, Vancouver, British Columbia.

Constance Clara Fogal is a lawyer and director of the Defence of Canadian Liberty Committee (le Comité de la Liberté CANADIENNEne) with an office at 401-207 West Hastings Street, Vancouver, British Columbia.

The Defence of Canadian Liberty Committee (le Comité de la Liberté CANADIENNEne) ("DCLC") is a non-profit society incorporated in the Province of British Columbia pursuant to the Societies Act with an office at 401-207 West Hastings Street, Vancouver, British Columbia.

Michael Goldie ("Mr. Goldie") is a hearing officer appointed by the Attorney General of Canada on July 5, 1999 pursuant to section 10(2) of the Expropriation Act.

Introduction
British Columbia joined the Canadian Confederation on May 16, 1871 pursuant to an Order of Her Majesty in Council. Georgia Strait and all submerged lands were part of British Columbia at the time British Columbia joined confederation, and remain part of British Columbia as confirmed by the Supreme Court of Canada.

Pursuant to s.117 of the Constitution Act, 1867, all public lands within the bounds of British Columbia belong to British Columbia subject to those required by the federal government for use in fortification or defence of the country.

Since 1967, the Canadian federal government ("Canada") has operated a test facility for torpedoes, sonar, sonobuoys and other maritime warfare equipment in an area of approximately 225 square kilometers of Georgia Strait at Nanoose Bay (the "Range"). The Range is approximately 35 nautical miles from Vancouver International Airport.

Canada allows foreign governments, principally the United States navy, to use the Range. Approximately 500 to 800 submarine launched torpedoes are fired each year on the Range. Because of the unique qualities of the Georgia Strait seabed, the fired missiles are easily recovered. Hence, in 1996, the United States navy said it had saved $2 billion over 30 years by using the Range.

Starting in 1984, after a Supreme Court of Canada ruling confirmed that British Columbia owned the Georgia Strait seabed, British Columbia and Canada signed a $1 per year licence agreement for the seabed under the Range which expires on September 4, 1999 (the "Licence").

On April 23, 1992, the British Columbia Legislative Assembly declared British Columbia to be a nuclear weapons free zone by a vote of 51 to 1.

The United States has an official policy of neither confirming nor denying the existence of nuclear weapons in its military and naval operations. However, nuclear powered submarines armed with nuclear weapons have frequented the Range.

On May 22, 1997, to protest United States overfishing of British Columbia salmon, Premier Glen Clark on behalf of British Columbia issued a 90-day Notice of Cancellation of the Licence. The Licence was cancelled on August 21, 1997.

In March of 1999, Canada requested a negotiated settlement. Negotiations commenced in April of 1999.

On May 5, 1999, senior negotiators for both British Columbia and Canada signed an agreement on points of principle for compensation, environmental stewardship and the prohibition of nuclear warheads.

On May 12, 1999, Canada announced that it would not abide by the agreement on points of principle of May 5, 1999.

On May 14, 1999, Canada announced that it would start expropriation proceedings pursuant to the Expropriation Act, R.S.C. 1995, E-21.

On May 22, 1999, the Minister of Public Works and Government Services, the Honourable Alfonso Gagliano (the "Minister"), published in the Canada Gazette a Notice of Intention to Expropriate the Range (the "Notice").

The Notice purports to require the Range "for a purpose related to the safety or security of Canada or of a state allied or associated with Canada."

On July 5, 1999, the Attorney General of Canada, the Honourable A. Anne McLellan appointed Mr. Goldie, retired justice of the B.C. Court of Appeal, to conduct a public hearing. Mr. Goldie is to file his report to the Minister by September 3, 1999. Although, pursuant to the Expropriation Act, the Minister has 120 days from the date of the Notice to confirm or abandon the decision to expropriate (September 19, 1999), the Licence expires September 4, 1999.

To date, the Minister, through Mr. Goldie or directly, has received over 2,800 objections. Mr. Goldie conducted public hearings at Nanaimo from July 19 to July 31, 1999, and at Vancouver from August 3, 1999 (the "Hearings"). The Hearings are scheduled to end on August 17, 1999.

Lack of Constitutional Authority
The federal government does not have a general power of expropriation. It can only expropriate pursuant to federal heads of power enumerated in the Constitution Act, 1867. Canada was created as a federal union and the object was not to subordinate provinces to the whims of the central government.

The Plaintiffs say that the Notice, the Hearings, and the whole expropriation process undertaken by Canada and Mr. Goldie pursuant to the Expropriation Act are a nullity for want of constitutional authority. The process is unconstitutional in its disregard for the province of British Columbia s jurisdiction over property and civil rights, and its propriety rights confirmed by the Supreme Court of Canada in 1984.

The Plaintiffs challenge the constitutional validity of the Expropriation Act and rely on section 117 of the Constitution Act, 1867. The Federal government has no power to expropriate lands or property belonging to the Provinces, except for lands or property "required for Fortifications or for the Defence of the Country". The Plaintiffs say that the Range is not required for the defence of Canada nor is it a fortification.

The Plaintiffs plead and rely on sections 109 and 117 of the Constitution Act, 1867, the Canadian Bill of Rights S.C. 1960, c.44, sections 1(a) and (e).

Nuisance
The Plaintiffs and the public of British Columbia have a right to health, safety, and security as guaranteed by section 7 of the Canadian Charter of Rights and Freedoms, the Magna Carta, the Bill of Rights (1688), and the preamble to the Constitution Act, 1867. The activities carried out by Canada and the United States are detrimental to the rights of the Plaintiffs and British Columbia citizens, the particulars of which include but are not limited to:

(i) In 1995, a nuclear carrier spilled a three-mile oil slick onto the Range;

(ii) In 1991, an American submarine snagged the nets of a British Columbian gillnetter, requiring the gillnetter to cut his nets; and

(iii) In 1994, a Chilean submarine en route from the Range struck and sank a British Columbia sailboat.

Three decades of torpedo testing have resulted in the dumping of 93,000 kilometers of copper wire, 2,200 tons of lead, lithium batteries, smoke flares, and other toxic materials onto the seabed of Georgia Strait both inside and outside the Range. The estimated cost of clean-up is unknown at this time. Particulars will be provided to the Defendants in due course.

The Defendant governments have permitted the use of ballistic missile submarines ("BS s") carrying nuclear weapons to enter Georgia Strait. These submarines can carry up to 24 missiles, with each missile armed with up to eight 100-kiloton nuclear warheads, for a total of up to 192 warheads per submarine. Furthermore, fatalities from even a minor shipborne reactor accident could reach 3,000 to 4,000. Air and ground contamination would spread at least 50 kilometers from the accident site, and would cause irreparable damage to the waters and fisheries of British Columbia. Since 1980 there have been numerous accidents on United States vessels carrying nuclear weapons or capable of carrying nuclear weapons, some of which have resulted in death.

All vessels entering or leaving the Range cross public shipping lanes including B.C. ferry routes. B.C. ferries come within two kilometres of the south-east corner of the Range.

The use of the Range by Canada and the United States for the purpose of testing, deploying, and carrying nuclear weapons is unreasonable interference with public and private interests. These are harmful activities which are of no use to the public and have caused injury to public property owned by all British Columbians. The use of the Range poses a threat to the health, safety and security of all citizens of British Columbia.

The Defendants generally are annoying the Queen s subjects and allies in British Columbia.

Breach of International Law
The International Court of Justice has determined that the threat or use of nuclear weapons is generally contrary to international law. By allowing the Range to be used for the testing, deployment, or carriage of nuclear weapons, both Canada and the United States are violating international law, committing crimes against humanity and depriving the Plaintiffs and all British Columbians to security of the person as guaranteed by s.7 of the Charter. The Plaintiffs have a legitimate expectation that Canada will uphold values of peace and disarmament and not behave like a war-mongering state.

Canada and the United States have deliberately and callously flouted international law, the Canadian constitution, and the decision of the people of British Columbia to be a nuclear weapons free zone, as a result of which high-handed and insensitive actions the Plaintiffs claim punitive damages.

WHEREFORE THE PLAINTIFFS CLAIM AS FOLLOWS:

(i) A declaration that the expropriation of the Range is ultra vires Canada save and except for expropriation pursuant to s.117 of the Constitution Act, 1867 which does not apply;

(ii) A declaration that any expropriation under s.117 of the Constitution Act, 1867 cannot be made by a general delegated law of expropriation but must be made by individual act of Parliament, and hence the Expropriation Act as against Provincial Crown lands itself is invalid and a nullity;

(iii) An interim injunction enjoining the Defendants Her Majesty the Queen in Right of Canada and Michael Goldie from taking further proceedings pursuant to the Expropriation Act and the Range;

(iv) A permanent injunction prohibiting Her Majesty the Queen in Right of Canada from expropriating the Range;

(v) General, special and punitive damages against Her Majesty the Queen in Right of Canada and the United States of America;

(vi) Costs; and

(vii) Such further relief as the Court deems meet and just.

the September 11 terrorist attack on the U.S. COAT decided that we could
not hold a festive event across from the US embassy in Ottawa. Instead we
have organized a Vigil for Nonviolence, on the same date, Oct 6, beginning
on Parliament Hill at 1 pm. We will walk in a silent procession -- to
"silence the violence" -- to First United Church for a program of speakers,
music and workshops. That program will begin at 2 pm.

We expect that most if not all of these endorsing NGOs would agree with the
new plans for our -- which has virtually all same speakers, musicians and
workshops that were planned for the Festival. However, we have been so
busy that we have not had the time necessary to correspond with all of

has outlived its usefulness -- and in fact is one which perpetuates the
notion of might is right and war is the way to a safe society. We need to

Instead of spending hundreds of billions for weapons of mass destruction
which we manufacture for ourselves and sell around the world, we should
allocate hundreds of billions of dollars for feeding the world's hungry,
housing the homeless, healing the sick and helping heal the wounds of war
and hatred around the world. As the Nonviolent Peaceforce recently
stated,"The only real security is for the United States to become a real
friend of all the world's people."

prejudice, hate and violence. Killing innocent civilians and destroying
non-military infrastructure constitute crimes against humanity.

State terrorism against terrorist movements only escalates the crimes.
Counter-terrorism can't end terrorism. The answer to prejudice and hate is
understanding and empathy; the anti-dote to violence is nonviolence.

Terrorism must be rooted out by eliminating its causes---dehumanizing
poverty, racism, religionism, sexism and victimization by domestic
dictators and foreign neo-colonial exploiters.

Islamic terrorism can be neutralized by establishing a stable and viable
Palestinian state, by ending economic sanctions against Iraq and Iran, by
forcing Pakistan to end its sponsorship of terrorist groups for Afghanistan
and Kashmir, by bringing about the democratization of all Islamic
dictatorships, and by initiating a Marshall Plan for the developing countries.

NGO Description: The international vision of New Humanism began to express
itself politically following the beginning of the formation of Humanist
Parties in different parts of the world in 1984. In January 1989, in
Florence, Italy, the political parties who supported New Humanism,
subscribed, at a public meeting, to an agreement to create a co-ordinating
body under the banner of the Humanist International. The International
would have the function of collecting and distributing information amongst
member parties; of disseminating humanist thinking and action and of
promoting international solidarity between nations struggling for their
political, economic and social liberation.

Solidarity message: Humanists are all those who struggle against violence
and discrimination, and who propose greater freedom of choice for the human
being. Humanists reject the formal political democracy that prevails in the
world today, which is manipulated by money and which deprives people of
real freedom of choice. Humanists promote human beings and their
fundamental needs as the central value and concern in society with no other
values or priorities imposed above them. This principle has enormous
consequences, particularly at a time and in a system where money is the
central value and everything else is subject to its 'tyranny'.

Amongst the present members of the Humanist International, in addition to
the Humanist Parties in over fifty countries, are the United National
Independence Party of Zambia, the National Democratic Party of Equatorial
Guinea, the Humanist Club of Moscow, and personalities of the Arts,
Sciences and Academia from many countries. Several initiatives and
publications of the HI have been produced in collaboration with
organisations such as the Academy of Science of Russia, the Gorbachov
Foundation, the University La Sapienza in Rome, and many others.

Solidarity Message: On behalf of Objection de conscience / Voices of
Conscience, we are happy to add our voice to the concert of the 100 or so
organisations who are officially endorsing your "No to NATO: Festival of
Creative Nonviolence".

As activists working to expose the ongoing war of sanctions and bombings
against Iraq, to present the resulting suffering of the Iraqi people, and
to denounce the total hypocrisy of the stated motivations behind this
policy, we fully share your goal of opposing the criminal actions and
violent policies of NATO and to hold NATO accountable for its violations of
international law. Even more importantly, we appreciate that COAT's work
focuses on raising Canadian awareness as to THEIR OWN COUNTRY's
participation in the machinery of violence aimed at imposing a new world
order everywhere on this planet. In our work to end the sanctions against
Iraq, we have also come to the realisation that Canadian policy on this
issue is among the worst world-wide. While Canada, as a country, claims to
espouse a culture of peace, it is merely using the legitimate longings of
its people for peace to cover up some very aggressive policies.

In conclusion, we would like to say that our chosen course of action is
non-violent. Thus we certainly agree that "non-violence is a powerful
medium of expression, an age-old tradition and an effective process for
cultural change". However, non-violence, as such, is not a founding
principle of our group. We have never held an internal debate to decide on
non-violence being 'the only way' in all circumstances, and we know that
individual opinions vary within our ranks on this matter. Some of our
members strongly believe that the right to self-defence -- which may entail
the use of violence -- should be recognized not only at the individual, but
also at the collective level.

This being said, our group wholeheartedly supports your work and the coming
Festival!

to American nuclear warship visits to Victoria and to Nanoose. Our
protests then and now are always creative, and of course, absolutely
non-violent.

Solidarity Message: Victoria Raging Granny's specific opposition to NATO
centres around the fact that it is under NATO and NORAD treaties that US
nuclear submarines are allowed to go to Nanoose Bay, BC to test their
weapon guidance systems, and to Victoria and Halifax for rest and
recreation. As well, Intercontinental Ballistic submarines (ICBM's)
regularly cruise past Victoria through the Strait of Juan de Fuca, and
have been known to cruise the inland passage to reach Nanoose Bay.

Here's a song we love to sing. It's called ATOMIC SUBMARINE and is sung to
the Beatles famous tune: "Yellow Submarine"
